Terms of Service

Eligibility

You must be at least 13 years old to use MemoryDensity. By using the service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

Access may be limited during early access or invite-only periods. We may change availability requirements at any time.

Description of the service

MemoryDensity is a free tool designed to help you reflect on daily experiences, log first-time moments, track a weekly Memory Density Score, and receive Time Capsule summaries of your week.

MemoryDensity is for personal reflection and general wellness motivation. It is not medical, psychological, psychiatric, or therapeutic advice, and it is not a substitute for professional care. The Memory Density Score is a motivational metric, not a scientific or clinical measurement. If you have concerns about your mental or physical health, consult a qualified professional.

Your account

• You sign in using a magic link sent to your email address. Keep access to your email account secure.
• Provide accurate information and maintain one account per person.
• You are responsible for activity that occurs under your account.
• We may suspend or terminate accounts that violate these Terms or misuse the service.

User content

You retain ownership of the content you submit, including prompt responses and first-time logs ("User Content").

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit it as needed to operate MemoryDensity. This includes showing your content back to you, including it in Time Capsules and notification emails based on your settings, and generating share images when you use the share feature.

Time Capsules store point-in-time snapshots of your week. Deleting individual prompt responses or first-time entries does not retroactively change content already saved in past capsules. Account deletion removes your capsules along with your other data.

You agree not to submit content or use the service to:

• Violate any applicable law or regulation
• Harass, threaten, or harm others
• Upload malware or attempt to disrupt the service
• Scrape, crawl, or reverse engineer the service except as permitted by law
• Access another user's data without authorization

Notifications

MemoryDensity can send daily prompt reminders and weekly Time Capsule messages by email or web push, depending on your Settings. By enabling these channels, you consent to receive transactional messages related to the service. You can change or disable notifications in Settings.

Emails are sent by Gavin Grant Consulting via our email provider. Weekly digest emails can be turned off in Settings.

Free service

MemoryDensity is currently offered free of charge. We may add, change, or remove features at any time. We do not guarantee uninterrupted availability, error-free operation, or permanent free access.

Intellectual property

MemoryDensity, including its design, branding, software, and curated prompt catalog, is owned by Gavin Grant Consulting and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the service.

Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimer of warranties

MEMORYDENSITY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAVIN GRANT CONSULTING AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF MEMORYDENSITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). BECAUSE THE SERVICE IS FREE, (A) WILL OFTEN BE ZERO.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Gavin Grant Consultingand its operator from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the service, your User Content, or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree that exclusive jurisdiction for disputes arising from these Terms or the service lies in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

Nothing in these Terms prevents either party from seeking relief in small claims court where available.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may notify you by email or through the app. Continued use after changes become effective constitutes acceptance of the revised Terms.
